Distance Sales Contract

This Distance Sales Contract applies to online orders placed on validushair.com. It explains the seller and buyer information, order formation, payment, delivery, withdrawal rights, return process, refunds, and dispute rules for distance sales.

This contract should be read together with the checkout information shown before payment, our Terms & Conditions, Privacy Policy, Shipping & Delivery information, and Refund & Return Policy. Mandatory consumer rights always prevail.

1. Parties

Buyer: the consumer or customer who places an order on validushair.com and whose details are entered at checkout.

2. Subject and scope

This contract governs the distance sale and delivery of products ordered through validushair.com in accordance with applicable Turkish consumer legislation, including distance contracts rules where applicable.

It applies separately to each order placed through the website, together with the specific product, price, payment, delivery, and pre-contract information shown during checkout.

3. Definitions

  • Website: validushair.com.
  • Products: cosmetic, hair-care, skin-care, body-care, supplement, tool, accessory, bundle, and related products sold by the seller.
  • Carrier: contracted shipping companies, which may include UPS or other logistics providers.
  • Durable medium: e-mail, invoice, order record, customer account record, or another format that allows the buyer to store and access information later.

4. Pre-contract information and acceptance

Before payment, the buyer can review key information including seller details, main product features, total price, taxes, shipping costs, delivery method, estimated delivery time, payment method, withdrawal rights, return rules, and customer service contact details.

By submitting an order, the buyer confirms that they have read the pre-contract information and this contract, and agrees to be bound by them.

5. Order and contract formation

The buyer’s order is an offer to purchase the selected products. The contract is formed when the seller confirms the order, accepts payment, or dispatches the products, whichever occurs first.

The seller may refuse, cancel, or refund an order due to stock unavailability, payment failure, suspected fraud, incorrect information, legal restrictions, compliance concerns, or technical error. Any amount due will be refunded to the original payment method where possible.

6. Prices and payment

Product prices, taxes, delivery costs, discounts, and the total amount payable are shown during checkout before payment. Errors and omissions are reserved.

Payments are processed securely by PayTR and/or iyzico, banks, card networks, or other payment methods shown at checkout. 3-D Secure or Strong Customer Authentication may be required. The seller does not store full card numbers or CVV codes.

Authorization may occur at checkout, and capture usually occurs when the order is accepted or dispatched, depending on the payment method.

7. Delivery

Orders ship from Istanbul and/or authorized suppliers through contracted carriers. Tracking details are provided when the order ships where tracking is available.

The buyer must provide accurate shipping address, telephone, e-mail, and delivery information. Delivery times shown on the website are estimates and may vary because of carrier capacity, customs, weather, public holidays, security checks, or local delivery conditions.

The buyer should inspect the parcel at delivery and note visible damage with the carrier where possible. Loss, damage, or non-delivery should be reported within 7 calendar days of delivery, or the expected delivery date for non-delivery.

International deliveries may incur customs duties, taxes, brokerage, remote-area charges, or local handling fees. Unless checkout states otherwise, these are the recipient’s responsibility.

8. Right of withdrawal

Consumers generally have the right to withdraw from a distance sales contract within 14 days after the day they receive the products, without giving a reason, unless an exception applies.

To exercise this right, the buyer must notify the seller within the withdrawal period by e-mail or another clear statement. The model withdrawal form below may be used, but it is not mandatory.

After notifying the seller, the buyer must return the products without undue delay and within 14 days of the withdrawal notice, following the return authorization and return-address instructions provided by the seller.

Unless the seller states otherwise or the law requires otherwise, the buyer bears the direct cost of return shipping and remains responsible for the products until they reach the seller. A trackable shipping method is recommended.

9. Withdrawal exceptions

The right of withdrawal may not apply to certain products or services, including:

  • Sealed products that are not suitable for return for health or hygiene reasons once unsealed, including opened cosmetics, hair-care products, or similar goods.
  • Products made to the buyer’s specifications or clearly personalized.
  • Products liable to deteriorate or expire rapidly.
  • Products that become inseparably mixed with other items after delivery.
  • Services fully performed with the buyer’s prior consent before the withdrawal period ends.
  • Digital content not supplied on a tangible medium once performance has begun with consent where applicable.
  • Services relating to accommodation, transport of goods, car rental, catering, or leisure activities for a specific date or period where applicable.

10. Return process

The buyer must request return authorization and the correct return address before sending products back. Products should be unused, complete, and in original packaging, including labels, seals, accessories, gifts, manuals, and protective materials where applicable.

Reasonable handling to establish the nature, characteristics, and functioning of the products is allowed where required by law. Using products beyond that may reduce or remove the right to a refund, especially for health or hygiene goods.

The buyer should include the order number and contact details in the parcel to speed up processing.

11. Refunds

For eligible withdrawals, the seller refunds payments received for the returned product and, where required by law, the standard delivery cost. Extra delivery charges chosen by the buyer may not be refundable.

The seller may withhold the refund until the returned products are received or until the buyer provides evidence of sending them back, whichever occurs first where applicable.

Refunds are issued to the original payment method unless agreed otherwise. Card issuers and banks usually post refunds within 3 to 14 business days after the seller submits them, but bank processing time is outside the seller’s control.

12. Defective or non-conforming goods

Mandatory statutory consumer rights apply for defective, damaged, expired, missing, or non-conforming goods. The buyer should contact the seller promptly with the order number, explanation, and clear photos or videos of the issue.

Depending on the circumstances and applicable law, remedies may include repair, replacement, price reduction, partial refund, full refund, or another lawful solution.

13. Personal data

The seller processes personal data to perform this contract, including order handling, payment confirmation, shipping, returns, customer support, security, fraud prevention, accounting, and legal compliance.

Payment data is handled by payment providers such as PayTR and iyzico. Delivery data is shared with carriers and logistics providers, including UPS where used, to deliver the order. More details are provided in the Privacy Policy and cookie or consent settings on the website.

14. Promotions and coupons

Promotional codes, bundle discounts, free gifts, and coupons must be used within their stated validity periods and conditions. They have no cash value and may exclude certain products, brands, categories, already-discounted items, shipping fees, taxes, or previous orders.

Refunds for promotional orders may be prorated to reflect the discount used. Fraud, misuse, automated redemption, resale activity, or violation of promotion rules may lead to cancellation or refusal of the promotion.

15. Records and evidence

Electronic records, including order logs, payment confirmations, invoices, consent records, notifications, shipping records, and customer service communications, are kept by the seller and may be used as evidence in case of disputes, subject to applicable law.

16. Force majeure

The seller is not responsible for delays or failures caused by events beyond reasonable control, including natural disasters, strikes, public authority actions, customs disruption, carrier failure, payment network outage, internet failure, cyber incidents, epidemics, war, civil unrest, or supply-chain disruption.

In such cases, obligations are suspended for the duration and impact of the force majeure event, and the seller will communicate practical options where possible.

Notices sent by e-mail are considered received when successfully sent, unless the sender receives a delivery failure notice.

18. Governing law and dispute resolution

This contract is governed by the laws of the Republic of Türkiye, without limiting mandatory consumer rights that apply in the buyer’s country of residence.

The buyer may apply to Consumer Arbitration Boards or Consumer Courts within the monetary limits and procedures set by law. Subject to mandatory consumer venue rules, İstanbul courts and enforcement offices have jurisdiction.

19. Miscellaneous

If any clause of this contract is held invalid or unenforceable, the remaining clauses remain in force. Headings are for convenience only and do not affect interpretation.

The current version published on this page prevails over printed, cached, translated draft, or prior versions unless mandatory law requires otherwise.
